The registry operates under the commercial code. This centralized system provides a public record of all registered liens. Lenders can search the database to ensure that an asset has not been pledged to another creditor.
Asset Registration
Filing a notice on the platform requires the debtor’s tax identification number and details of the secured assets. This registration must be updated if the loan is restructured or paid off. If the registry entry is not kept current, the lender can lose their priority status.
This makes regular monitoring of filings a necessary practice.
Priority Claim
The date and time of the registry filing determine the lender’s priority in a default scenario. First-registered filings are satisfied before subsequent claims. This protection gives lenders the confidence to finance bulk concentrate stockpiles and equipment.
It reduces the risk of loss during debtor insolvency. If the filing is omitted, the lender’s claim is treated as an unsecured debt.
