Meaning
A judicial seizure of a vessel constitutes a maritime arrest when a claimant secures a ship to guarantee a debt or a maritime lien. The process functions through a court order that physically detains the craft within a specific jurisdiction to prevent departure before the settlement of a claim. It applies exclusively to claims connected to the vessel itself, such as unpaid bunker fuel, collision damages, or salvage services.
The legal mechanism terminates upon the provision of sufficient security, usually a bank guarantee or a protection and indemnity club letter of undertaking.
Detention Procedure
Courts issue a warrant of arrest upon the filing of a verified complaint that provides evidence of the underlying debt. Bailiffs or port authorities then notify the master and place a physical notice on the hull to ensure the ship remains at the berth. This formal restraint prevents the owner from trading the asset, thereby compelling the settlement of obligations through the freezing of the owner’s primary revenue source.
Security Requirement
Financial protection remains the primary objective for any entity initiating the action. Claimants must often lodge a counter security deposit to protect the shipowner against wrongful arrest damages if the court eventually finds the claim meritless. The total amount reflects the value of the demand plus potential interest and legal costs.
Providing this collateral allows the vessel to sail under a substitute security arrangement.
Jurisdictional Scope
Maritime law treats every arrest as a local action bound by the rules of the port state. Vessels often move between jurisdictions, yet the arrest order stays strictly within the territory of the court that issued the mandate. Conflicts arise when multiple jurisdictions claim authority, but the first court to seize the ship typically maintains control over the distribution of sale proceeds if the vessel undergoes a judicial auction.
Execution of this measure stops the ship from performing its commercial duties until the underlying dispute reaches a resolution.
