Compensatory Balance
Valid covenants require the employer to pay a minimum level of compensation to the departing worker. Under handelsgesetzbuch section 74, the agreement must promise a payment of at least half of the employee’s previous remuneration for each year of the restriction. If the employer fails to include this financial compensation in the written agreement, the non-compete obligation is non-binding.
This statutory link ensures that workers do not bear the entire economic burden of the restriction.
