It provides a temporary breathing space that prevents individual lenders from dismantling the company for their own benefit.
Statutory Stay
Legal orders prevent secured and unsecured lenders from enforcing their claims immediately. This period of creditor protection freezes the status quo, allowing the management to continue daily operations without the threat of liquidation. The duration of this freeze is determined by the court and is often extended if the debtor shows progress.

Financial Restructuring
Debt advisors use this protected period to draft a plan of arrangement or a proposal to the lenders. The process of creditor protection allows the firm to negotiate lower interest rates, extended payment terms or debt-for-equity swaps. This negotiation requires the consent of a majority of lenders, who must vote on the plan before it is submitted to the court for final approval.
If the plan is rejected, the protection ends and the company usually enters bankruptcy. The outcome of a successful restructuring is a leaner company with a sustainable balance sheet. Lenders often accept a write-down because it yields a higher recovery than immediate liquidation.
Asset Preservation
Company directors must safeguard the remaining value of the business during court proceedings. Under creditor protection, the sale of major assets is restricted to prevent the depletion of the estate. Any transaction outside the ordinary course of business requires court authorization.
