This communication, called a cisg article 39 non-conformity notice, governs the buyer’s right to claim damages or refuse acceptance of defective goods. The right to send this message expires at the latest two years from the date on which the goods were handed over.
Communication Rule
Senders must describe the defect in detail rather than using generic claims of poor quality. If a shipment of steel coils has surface rust, the notification must specify the rust location and severity. Simply stating that the shipment is damaged does not satisfy the legal requirement.
Commercial Remedy
Timely delivery of the notification preserves the buyer’s right to demand replacement goods or price reductions. Waiting too long eliminates these legal remedies completely.

Procurement departments establish automatic alerts linked to goods receipt dates to track the notification window. Because courts often interpret a reasonable time as one month, speed is critical. Establishing pre-drafted templates for notifications helps shipping departments respond immediately when receiving inspections fail.
