A possessory legal right allows a service provider to retain physical control over a piece of property until the owner pays for the labor or materials used to improve it. This artisan lien arises through common law or specific state statutes and applies to the specific item repaired or enhanced. The right terminates as soon as the service provider voluntarily returns the property to the owner.
Possession Condition
Physical custody of the tool or machine is the only way to maintain the security interest. If a mechanic returns a repaired generator to a factory before receiving payment, the artisan lien is lost and cannot be revived by regaining possession later. This requirement forces a direct exchange of payment for the release of the asset.
Value Addition
Labor performed must result in a physical improvement or restoration of the equipment. A technician who merely inspects a vehicle without performing a repair may find that the artisan lien does not apply in certain jurisdictions. The cost of materials used in the process is also protected under this claim.
Enforcement Method
Sale of the property provides the mechanism for recovering unpaid debts. Most jurisdictions require a waiting period followed by a public notice before the holder can sell the asset. Proceeds from the sale cover the repair costs and any storage fees incurred during the holding period.
