Meaning
Legislative provision in the German Insolvency Code that establishes the framework for recognizing insolvency proceedings initiated outside the country. The rule known as insolvenzordnung section 343 removes the requirement for a separate recognition judgment in most instances.
Recognition Standard
Automatic recognition applies to foreign proceedings when the center of main interests of the debtor is located in the state of the opening court. This aspect of insolvenzordnung section 343 allows the foreign administrator to exercise powers over assets located in Germany. Local courts verify the competence of the foreign authority before granting full legal effect to the order.
Jurisdictional Boundary
Evidence of the center of main interests must be presented to the court. While the capacity to file exists globally, the capability to obtain recognition under insolvenzordnung section 343 depends on the location of the debtor’s primary executive functions. Calling for recognition before this center is firmly established often results in jurisdictional challenges and high legal costs.
Procedural Effect
Recognition grants the foreign administrator the right to recover assets and stay local enforcement actions. Under insolvenzordnung section 343 the foreign proceeding is treated as if it were opened under local law. Recognition remains valid as long as the foreign proceeding continues to meet the statutory criteria.
