Meaning
Trade definitions place the minimum obligation on the seller by requiring them only to make goods available at a specified location. Under ex works, the buyer carries all costs and risks from the moment the items are collected at the factory or warehouse. The seller is not responsible for loading the goods onto the collecting vehicle.
Export clearance also falls under the buyer responsibility.
Collection Point
Sellers fulfill their delivery duty by providing notice that the order is ready for pickup at the designated bay. This location is often the manufacturer plant or a nearby storage facility. Once the buyer arrives, the physical handover of control is complete.
Logistics Burden
Arranging transport from the origin to the final destination involves securing carriers and managing transit documentation. The buyer must also handle any export licenses required by the local government. These tasks add complexity to the procurement process for the importing party.
Buyer Risk
Physical damage occurring during the loading process is the responsibility of the purchasing party. Even if the seller staff assists with a forklift, the legal liability remains with the buyer. This term represents the most substantial shift of effort away from the supplier in the international supply chain.
The buyer assumes all liability for the goods once they leave the seller floor.
